The U.S. Court of Appeals for the District of Columbia has acting on behalf of CHLORINE CHEMISTRY COUNCIL (an industry group) has found that EPA violated the Safe Drinking Water Act when it set MCLG = 0. Following seq of events - Chloroform which EPA classifies as probable human carci nogen; acts INDIRECTLY, triggering cancer through cell damage & regrowth rather than by DIRECTLY interacting with DNA - Originally on account of above, EPA proposed a MCLG value of 300 ppb - In 12.98; under pressure of environmental groups; EPA fixed a definitive MCLG value of 0 - EPA said it would stick with 0 until SAB reviewed agency conclusions on how Cl3CH causes cancer - The CHLORINE CHEMISTRY COUNCIL, then sued EPA, claiming the agency ignored scientific data. - In 03.00, SAB endorsed a risk assessment method that will lead to Cl3CH MCLG > 0 - EPA spokeswoman said the agency plans to reevaluate the rule in light of SAB report |
